According to the Federal Motor Carrier Safety Administration (FMCSA), “Speeding of Any Kind” was recorded for 34% of the large truck drivers in fatal crashes.

Overloading Trailers

Overloading trucks or trailers puts additional strain on the vehicle, particularly the brakes and tires. Towing a trailer with a weight heavier than the towing vehicle will lead to loss of control, especially down hills.

Driver Fatigue

Working long daily and weekly hours on a continuing basis is associated with chronic fatigue, a high risk of crashes, and a number of serious chronic health conditions in drivers. Federal regulations designed to improve safety for the motoring public by reducing truck driver fatigue include:

  • Limiting the maximum average work week for truck drivers to 70 hours, a decrease from a maximum of  82 hours;
  • Allowing truck drivers who reach the maximum 70 hours of driving within a week to resume if they rest for 34 consecutive hours, including at least two nights when their body clock demands sleep the most – from 1- 5 a.m., and;
  • Requiring truck drivers to take a 30-minute break during the first eight hours of a shift.
Driving Under the Influence of Drugs or Alcohol

Because of the potentially devasting consequences of an accident, commercial drivers are held to higher standards when it comes to driving under the influence. Under Vehicle Code 23152 VC, commercial license holders are guilty of DUI if a chemical breath test or blood test show that you have a blood alcohol concentration of (“BAC”) of 0.04 percent or above. This is half the BAC limit for non-commercial drivers.

California DUI laws also include illegal drugs as well as some medications that can impair driving or judgment.
